Covenants, Conditions, and Restrictions:
Primary Use. The Burdened Properties' primary use shall be as a residence for a single family and for no other purpose. The Burdened Properties shall not be used for any retail, commercial, or industrial uses.
Restrictions on Further Subdivision. No further division of any lot shall be permitted.
Repair. All structures and buildings located on the Burdened Properties shall be kept in good repair and in a generally attractive condition.
Refuse. No trash, garbage, rubbish, refuse or other solid waste of any kind, particularly
including inoperable automobiles, appliances, or furniture, shall be thrown, dumped, stored, disposed of or otherwise placed on any part of the Burdened Properties.
Animals. All animals must be secured within the boundaries of their owner's lots or under the direct control of their owner via a leash outside of the lot boundaries. Owners shall be
responsible for picking up all animal waste.
Temporary Dwelling. No temporary dwellings, including, but not limited to, mobile, modular, manufactured homes, or trailers shall be used on any of the Burdened Properties at any time, either temporarily or permanently. Notwithstanding the foregoing, temporary dwellings, including, but not limited to, mobile, modular, manufactured homes, or trailers may be permitted on the Burdened Properties during the construction phase only, not to exceed a period of one year.
Binding Upon Successors. The restrictive covenants herein, shall remain in full force and
effect running with the land and binding upon the Burdened Properties and any and all
parts thereof, all owners and other parties in interest thereto and their heirs, assigns, personal representatives and successors in interest. Accepting an interest in and to any portion of the Burdened Properties shall constitute an agreement by any person or entity accepting such interest, that they and each of them shall be bound by and subject to the provisions of this instrument. The covenant shall be binding upon and effective against any owner whose title is derived through foreclosure or trustee's sale or otherwise.
Enforcement. The owners and other parties in interest in and to any part of the Benefitted
Properties, and each of them, in addition to any other remedy for damages or otherwise,
shall have the right and authority to enforce the provisions hereof and the right to injunctive relief. The prevailing party in any action to enforce any provision thereof shall recover a reasonable sum as attorney's fees and the costs of the action including reasonable cost of searching and abstracting the public records which sum shall be paid by the unsuccessful party.
Amendment. This Declaration may be amended upon unanimous approval by the owners of Lots 1 through 10, identified herein. No amendment, alteration or change shall be effective until recorded in the office of the Auditor of Douglas County, Washington.
